NAR Wins One Count Against ATF on Summary Judgement Motion

On March 19, 2004, Judge Reggie B. Walton, Federal District Court for the District of Columbia, ruled in favor of the NAR / TRA position in Count 2 of our lawsuit brought against the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE). The NAR / TRA lost Count 1 which sought removal of the classification of ammonium perchlorate composite propellant ("APCP") as an explosive.

Our legal team in Washington, DC is in the process of reviewing and analyzing the complete text and citations in the opinion. We expect to have a formal announcement from them about the implications and next steps in the next 7 to 10 days. We will provide all the guidance we can to members concerned about their use of APCP motors in our next announcement. We are also analyzing the opinion in light of our legislative agenda, and I hope to have additional feedback on that front at that time.
